Terms of Use

1.1 Age requirement; authority. To use the Site, you must be at least 18 years old. You represent that you have read and understood this Agreement, agree to be bound by it, and are at least 18 years old. If you do not agree to, or cannot comply with, any term of this Agreement, do not attempt to access the Site.

1.2 Registration. We reserve the right to restrict certain information to approved registered users. If an area requires registration, you agree to provide truthful information, which may include a member name and password, your name, address, telephone number, and valid email address (the “Account Information”).

You agree to keep your Account Information accurate. Wyn Group LLC will handle it in accordance with its privacy practices. You are responsible for protecting your member name and password and for notifying us immediately of unauthorized account use. Wyn Group LLC is not responsible for losses arising from unauthorized use of your account. You agree to indemnify and hold harmless Wyn Group LLC, its partners, parents, subsidiaries, agents, affiliates, and licensors for improper, unauthorized, or illegal uses of your account.

2.1 Grant of license. Wyn Group LLC grants you a limited, non-exclusive, non-transferable license to access and use the Site under this Agreement. Wyn Group LLC reserves all rights not expressly granted to the fullest extent permitted by law. Any use not specifically permitted is prohibited.

2.2 Restrictions. You agree not to use the Site to reproduce, transmit, display, or distribute copyrighted material without Wyn Group LLC’s express written permission. You also agree not to copy, store, edit, change, prepare derivative works from, or alter Site content, or to use the Site in violation of this Agreement.

The Site is owned by Wyn Group LLC and protected by United States copyright laws and international treaty provisions. You may not sublicense, assign, or transfer the license granted by this Agreement. Any attempt to do so is void.

You agree not to impersonate any person or entity or misrepresent your affiliation with another person or entity. You may not engage in spamming, flooding, harvesting email addresses or personal information, spidering, screen scraping, database scraping, or other activity intended to obtain user lists, property listings, or other information. You may not send chain letters or pyramid schemes through the Site or attempt to gain unauthorized access to other computer systems.

You may not use the Site in a manner that could damage, disable, overburden, or impair it, or interfere with another party’s use and enjoyment of the Site.

4.1 As between you and Wyn Group LLC, you acknowledge that Wyn Group LLC owns or licenses all title and copyrights in the content provided on the Site. Intellectual property rights in licensed content belong to the respective owners and may be protected by applicable laws, treaties, and use restrictions.

4.2 Photos on the Site are the property of their respective owners. Using these images without the owner’s express written consent is prohibited.

Wyn Group LLC, its design logo, and certain other marks, service marks, graphics, and logos used with Wyn Group LLC’s products and services are Wyn Group LLC trademarks. The Site may also contain third-party trademarks, service marks, graphics, and logos. You receive no right or license to use Wyn Group LLC trademarks or third-party trademarks.

Unless otherwise addressed in this Agreement, your use of the Site is subject to Wyn Group LLC’s privacy practices, which are incorporated into this Agreement. Wyn Group LLC may cooperate with and disclose information to an authority, government official, or third party, without notice, in connection with an investigation, proceeding, or claim involving asserted illegal action or infringement related or unrelated to your use or misuse of the Site.

If you submit or post a property listing, testimonial, comment, review, suggestion, or other work of authorship (a “Submission”), it will not be confidential or secret and may be used by us. Do not submit information you consider confidential or proprietary. We do not pre-screen Submissions and have no obligation to read any particular Submission.

By sending a Submission, you represent and warrant that it is original to you, that no other party has rights to it, and that any moral rights have been waived. You grant us a royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive, transferable, assignable, and sublicensable right and license to use, reproduce, publish, distribute, display, translate, summarize, modify, adapt, or incorporate it into other works in any current or future medium, with or without your name.

This Agreement remains effective until terminated by you or by us.

9.1 The Site and all content are provided “as is.” Use is at your own risk. To the fullest extent permitted by law, Wyn Group LLC disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. Wyn Group LLC does not represent or guarantee that the Site will be free from loss, destruction, damage, corruption, attacks, viruses, interference, hacking, or security intrusions and disclaims related liability.

9.2 Wyn Group LLC does not represent or guarantee that the Site or its content will be accurate, reliable, current, uninterrupted, or error-free. Without notice, Wyn Group LLC may modify, suspend, or discontinue any part of the Site or your use of it without liability to you or a third party.

9.3 Property listing information is subject to errors, omissions, price or condition changes, prior sale, lease, financing, or withdrawal without notice. Projections, opinions, assumptions, or estimates are examples only and may not represent current or future property performance. You and your tax and legal advisors should independently investigate any listed property and contemplated transaction.

9.4 You submit information to us at your own risk. Wyn Group LLC assumes no liability for loss or liability related to that information.

9.5 Some content, products, and services may include third-party materials. Wyn Group LLC assumes no responsibility for those materials, products, or services.

Wyn Group LLC will not be liable for indirect, general, special, incidental, consequential, exemplary, or other damages, including lost profits, business interruption, file corruption, loss of business information, or other pecuniary loss, even if advised of the possibility of those damages.

No oral or written information or advice from Wyn Group LLC or others creates a warranty, and neither you nor a third party may rely on it. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so these exclusions and limitations may not apply to you.

You will indemnify and hold harmless Wyn Group LLC, its directors, officers, employees, affiliates, agents, contractors, and licensors against suits or claims arising from your breach of this Agreement, including infringement of a third party’s copyright or intellectual property rights, or your use or misuse of the Site.

12.1 You are responsible for the internet access, hardware, and software needed to use the Site.

12.2 Wyn Group LLC complies with applicable laws, including privacy laws and state laws governing the sale or lease of real property. You agree to comply with laws applicable to you.

12.3 Wyn Group LLC or its business partners may present advertising or promotional material through the Site. Your dealings with third-party advertisers are between you and that third party and subject to the promotion’s terms. Wyn Group LLC is not liable for loss or damage resulting from those dealings or third-party materials.

12.4 Copyright notices. If you know of or suspect copyright infringement, send a notice containing the information required by 17 U.S.C. § 512(c)(3)(A) to Wyn Group LLC, 1178 Burnsville Center, Burnsville, MN 55306.

12.5 This Agreement is governed by the laws of California. Exclusive jurisdiction for a claim, action, or dispute with Wyn Group LLC or related to your use of the Site lies in the state and federal courts of California, with venue in Los Angeles County.

12.6 Wyn Group LLC may provide notices about your Site use by email to the address in your Account Information, by U.S. mail to the contact address in your Account Information, or by posting a notice when you access your account. Unless stated otherwise, notices are effective immediately.

You acknowledge that you have read and understood this Agreement and will be bound by it. This Agreement is the complete and exclusive statement of the agreement between us about its subject matter and replaces prior proposals, agreements, and communications, whether oral or written.
